Daniel and Kelly Rutherford met in 2006 and instantly fell in love. The couple welcomed their son Hermes Gustaf Daniel Giersch after only a few months of marriage. The couple married in August 2006. In addition, Helena Grace Rutherford Girsch, the ex-second couple’s child, was born on June 8, 2009, after the couple divorced.
The couple was going through a bad patch in their marriage at the time. They were unable to resolve their issues, resulting in the dissolution of their marriage. Kelly filed a custody case in New York, but the court dismissed it because it lacked jurisdiction.
Daniel Giersch and the Gossip Girl star have reached a temporary custody agreement for their children. They ran into trouble when Daniel was deported from the United States in 2012 after his visa expired. A California judge ordered their children to reside with their father in Monaco in August 2012.
However, after three years in France, actress Rutherford was granted temporary exclusive custody of her children in 2015. Overall, the Monaco court granted their father full custody of the children in December 2015. The German billionaire has had full legal custody of their children since then and currently resides in Monaco.
