Dan's improper behavior was first brought to the attention of the producers during the early days of the season when the MBA student Kellee Kim flagged the issue. 

Despite her comments, Dan wasn't ejected from the game immediately. This ignited further conflicts within the team, and regardless of her efforts, Kellee failed to secure the majority required to get the talent manager voted off. 

Kelly was eventually voted off the island, while Dan stayed on.
